The landscape of employment tribunals has experienced a significant shift in recent years. The numbers of cases being brought before tribunals has steadily increased, reflecting a growing trend that has implications for both employers and employees.
In 2022/23, the total number of employment tribunal cases reached unprecedented levels. The annual and quarterly interim totals for receipts, disposals, and open caseload all showed substantial increases compared to previous years. His Majesty’s Courts & Tribunals Service (HMCTS) recorded an interim total of 350,000 receipts and 298,000 disposals in the 2022/23 financial year, with an open caseload of 651,000 at the end of that period.
These figures represent:
- 16% increase in receipts,
- 13% increase in disposals,
- 5% increase in open caseload compared to the previous financial year.
The increases can be attributed to various factors. One significant factor is the impact of the COVID-19 pandemic on employment practices. The economic fallout from the pandemic led to widespread job losses, furlough schemes, and changes in working conditions. Disputes arising from these circumstances have contributed to the rising number of employment tribunal cases.
Additionally, changes in legislation and increased awareness of employee rights have empowered workers to challenge unfair treatment in the workplace.
Furthermore, the growing availability of legal representation and the ease of accessing legal advice have made it more feasible for individuals to pursue employment tribunal cases. Employees now have greater access to legal information and support, leading to a rise in the number of claims being brought forward. It is crucial for individuals to be aware of their rights, keep abreast of changes in employment laws, and seek legal advice when necessary.
Employers must now ensure that they are aware of and comply with employment laws and regulations to avoid potential legal disputes. Implementing fair and transparent policies, providing adequate training and support to employees, and addressing workplace issues promptly can help reduce the risk of employment tribunal cases.
The Employment Tribunals have also witnessed a rise in cases, although the data for specific time periods is subject to checks due to database migration and operational differences. In Q4 2022/23, there were 23,000 employment tribunal receipts, with 8,100 of those being single claims and the remaining 15,000 being multiple claims. Disposals for the same quarter reached 20,000, while the open caseload stood at 477,000.
It is important to note that the transition to a new case management system has impacted the reporting of employment tribunal data. However, the overall upward trend in employment tribunal numbers indicates a growing need for legal intervention in workplace disputes.
As employment tribunal numbers continue to rise, it is essential for all parties involved to navigate the legal landscape effectively and strive for fair resolutions to workplace disputes.
